Guilty of murder?

How the fukk does this happen?

It is quite obvious what happened here. A tired distracted women made a terrible mistake.

Should she get some type of punishment?

Sure.

Should she ever be allowed to carry a gun again, much less serve as a cop?

Fukk no!

But how the fukk is this murder?

Some form of manslaughter? Yeah, I guess.

If the dude she shot was white, there's no fukking way a DA even brings up a murder charge.

This was another case of "innocent balck man gets shot by the police" and dammit, we need justice!!!!

I suspect that she'll get a good legal team and this will get knocked down to what it was, some level of manslaughter.

She was a dumb bitch that made a really bad, but innocent mistake.

Murder is a planned homicide. No one in their right mind would think this bitch planned any part of this.

Testimony was given that people walking into the wrong apartment is a common occurrence in this complex. I suspect it is generally caused by people being cell phone zombies. This was likely the case here.

But of course, you don't give a fukk about actual justice. You're a just a cop hating POS and this plays to your pathetic systemic racism narrative that you rely on to get minorities out to the polls so you can have your free healfcare or whatever it is you want.

There are asshole cops who abuse their badges. If this woman knowingly walked into this dude's apartment because he was playing his record player too loud and shot him, she'd be guilty of being a JUBM.

She didn't.

She MISTAKENLY walked into the wrong apartment.

Dude likely thought she was an intruder and decided to take her out. She thought he was attacking her.

Whether he was balck white or purple didn't matter. She saw someone a good bit larger than her coming towards her in what she took to be a threatening manner. She pulled her gun and shot him.

It was a tragic mistake.

She should never carry a weapon again.

But she shouldn't spend her life in jail either.

Care to wager on how this ends?

It'll go to re-trial. She will be found guilty of some form of manslaughter. She'll prolly walk out with time served.

I would like to see a judgement against her to the family of the victim. Let her get her ass to work as a bank teller or at starbucks so she can pay the poor mother of the man she killed. This won't happen with her sitting in prison.

Sounds like you did your job and the DA agreed with it. Or at least the jury did.

Your client goofed up. He paid a reasonable price for his goof up.

By your logic, your own client should have had the book thrown at him.

Why is it you don’t want similar justice for others?

No one is arguing she didn’t fukk up in a major way.

She did.

She lost her job and will have to live with what she did forever.

But she shouldn’t go down for murder. Manslaughter was the appropriate sentence.

I will take responsibility for saying house, but they are cookie cutter houses with two doors and sold as condos. The point being they are easily mistaken.
He did fuck up which is why he plead to the 602. That’s the whole point. You fuck up you pay and as long as you fucked up in a legal sense then it’s the legal system that decides the punishment. In my guy’s case a 602, in her case a murder rap.

As a side note (and at the risk of burying the lead) the home owner was deer hunting when he saw some quail and switched to bird shot before he got home and put his shotgun by the bed or my guy would have a deer slug in him and not the few birds shot pellets he ended up with that made it thru the side door and if that happened I probably would not have had a client in the first place.

I don’t know how her attorneys handled the negotiations with the DA if there were any, but I would have pushed for manslaughter if I came in after the indictment for murder. As for as the trail, I didn’t see much of it but I would have done basically the same thing. “It was a horrible mistake and is a civil not criminal matter.”
Now I don’t believe that so I would not have even taken the case, that and my conflict of interest because I want to see her do hard time. But money changes everything. :?

I don't lock my door when I'm home. Hell, I rarely lock it when I'm away, but I live in a pretty boring ass safe place and I really don't have anything of seriously high value there. Plus there is the fact that if someone really wants in. they'll get in.

So basically, it sounds like if these are just two random people, you'd be for a reasonable charge of manslaughter. But, she's a cop, so fukk her.

You are right that the defense should have told her to plead to manslaughter. Maybe her attorney was a dumbfukk who thought he could beat even manslaughter.

If that is the case, he's an idiot and he ought to be in jail with her.

My guess is that next time around this gets settled at manslaughter.

The Rodney King trial where the state over reached, going for attempted murder and the jury didn't buy it. They should have went down for aggravated assault.

Then the nogs burned their hood down and the feds stepped in and appeased them by going after them on federal charges. This was blatant double jeopardy and it sent out a message to savages everywhere.

As an aside, I have sat through many victim impact statements and many of them were next of kin to murder victims. We don’t get the likes of Brandt Jean very often so they stand out when we do. Gwen Araujo’s Mom Sylvia was one of those exceptions. Very powerful lady, lots of respect for her.

Assuming she does get out in 5, I think that's pretty fair. I would have perfered 5 years for manslaughter, but I guess thats not what's really important.

It was probably appropriate that the judge gave her a hug and a bible after sentencing her. Because men who get convicted of horribly violent crimes usually get goodbye hugs from judges too.
