Trump Organization and CFO Allen Weisselberg Expected to Be Charged Thursday

The Manhattan district attorney’s first charges in three-year probe will focus on alleged tax-related crimes at former president’s company

The Manhattan district attorney’s office is expected to charge the Trump Organization and its chief financial officer with tax-related crimes on Thursday, people familiar with the matter said, which would mark the first criminal charges against the former president’s company since prosecutors began investigating it three years ago.

The charges against the Trump Organization and Allen Weisselberg, the company’s longtime chief financial officer, are a blow to former President Donald Trump, who has fended off multiple criminal and civil probes during and after his presidency. Mr. Trump himself isn’t expected to be charged, his lawyer said. Mr. Weisselberg has rejected prosecutors’ attempts at gaining his cooperation, according to people familiar with the matter.

The defendants are expected to appear in court on Thursday afternoon, the people said.

The Trump Organization and Mr. Weisselberg are expected to face charges related to allegedly evading taxes on fringe benefits, the people said. For months, the Manhattan district attorney’s office and New York state attorney general’s office have been investigating whether Mr. Weisselberg and other employees illegally avoided paying taxes on perks—such as cars, apartments and private-school tuition—that they received from the Trump Organization.

If prosecutors could show the Trump Organization and its executives systematically avoided paying taxes, they could file more serious charges alleging a scheme, lawyers said.

Mr. Weisselberg and his lawyers haven’t commented on the investigation or impending charges.

The statute of limitations says when the charges must be filed by, not some jet jockey.

Exactly. Weisselberg refused to cooperate with prosecutors, but I doubt he'll be able to help Trump. At the very least not w/o committing perjury. Additionally, I've read that Weisselberg's cooperation won't even be necessary in order to prosecute members of the Trump crime family. And I've read reports that Ivanka recently DID commit perjury while talking to federal investigators. Combined with her brothers Dumb & Dumber (don't ask which is which, apparently it's a competition) Mar-a-Lago will eventually be emptied out.

And prosecutors have yet to file on Trump's loan fraud....

This ain't all of it. There's still the question of what Ivanka (& possibly her father) did with the 2017 inauguration funds as well as loan fraud for Trump over-inflating his assets while applying for loans. I'm sure there will be more.

Well, maybe I am missing something, but if the money was paid to a consulting company and then the consulting company paid it's employee, what exactly is wrong with that?

My wife and I own the main company (call it flying) that I set up. My wife is an employee of a major insurance and financial services company. She also has an LLC in her name that is set up as a consulting company (call it consulting). When she does work for the main company (flying) that we own, the company (flying) pays her LLC (consulting) for her time and expertise. The main company (flying) then takes a deduction for the funds paid to her LLC (consulting) as a business expense. Her LLC (consulting) doesn't pay her a salary, instead it has expenses that the income she gets from doing work for (flying) covers. For example the LLC (consulting) owns her SUV and pays for all of the expenses of said vehicle.

So what exactly is illegal about payments to a consulting company owned by someone else? As long as those payments are all documented and the appropriate deductions and taxes were reported/paid along the way, what is wrong? Were the payments a way to reduce the companies business expenses? Yes, I am sure. However, that alone doesn't make it illegal.

Now, all of these shell games are just stupid. The tax code should be changed to do away with all of this and we should just move to a flat tax with zero deductions for businesses, individuals, etc, etc. Hell, I would even be in favor of an estate tax with a flat 10%.
