1) When has a Taser been considered a lethal weapon when practically every police department in the country would argue they are not as a means to justify their continued use of them?

2) How effective can a Taser be when fired blindly over ones shoulder at someone while running away from that person that is chasing them?

3) How can a suspect running away from a police officer be considered an imminent threat to the officer, justifying the use of lethal force?

4) The suspect was an older guy, carrying a few extra pounds and drunk, by their evaluation, how far did they think this guy would be able to maintain a sprint to get away? Aren't JUBM's supposed to maintain of modicum of physical fitness that would enable them to keep pace with this guy by the time he stops to have a heart attack?

5) Was the suspect already frisked such that the JUBM's knew that he had no additional weapons on him after he unsuccessfully tried to use the taser?
