The only entity that should be deciding who gets married and who does not is the individual church at which two people want to get married.

Both sides have already spent way too much money on a moot argument, since it falls under equal protection and everyone's known that from the start.

I really wish that I could give a shit, one way or the other... but I don't.

I'll acquiesce to what the voters in my state decide (which was "no," but the closest such vote of any state that's had one).

Although, I have a sneaking suspicion that it's all about getting a free ride -- why else would anyone need this "affirmation" if it wasn't to get over (note: I have no problems with people being able to name any beneficiary, responsible party, or anything else, regardless of any relationship or gender).


But, as usual, I think 88's stance on Constitutionality is nails... unless someone can show me the amendment that cites marriage specifically.

As far as Diego's take that "marriage HAS priviledges" -- then those should probably be outlawed, no? Since people who CHOOSE to not marry aren't afforded those same priviledges, now are they?... you know, that whole "equal protection" thing and all... ridiculously non-Constitutional take, and pretty much a KYOA moment.

When there is a defect or flaw in our Constitution, the Constitution has a remedy: it can be amended. When the People realized that slavery was wrong, they didn't look to the Supreme Court to fix it. They fixed it (after a nasty ass war) by amending the Constitution. The same was true for the right of women to vote and many other issues. But the Judiciary has taken it upon itself to amend the Constitution outside of the process by which the People consented.

Prop 8 doesn't deprive anyone of liberty. It doesn't deprive them of property. People are free to live together as they choose. They are free to act or behave or love or do whatever it is they want without government interference. What it does do is prohibit people from calling their same sex relationships the same thing as opposite sex relationships, and from requiring the People to acknowledge and respect a non-traditional relationship that the People presently do not wish to acknowledge and respect as equal to traditional marriage.

If the homosexual political lobby can make a good case for changing the views of the People, then they should do so. And they should encourage the People to change the definition of marriage to encompass their non-traditional relationships. They could get their state legislatures to enact same sex marriage laws. And ultimately, convince the People to consent to an amendment of the Constitution.

But they aren't willing or are not able to do that. So they get the Court to find a right where no such right previously existed. Their ability to use the Judicial Branch to obtain a legislative victory subverts the process. And, it weakens the faith of the People in their government, because it forces the People to act and live in a way in which they have not consented. That is tyranny my friend. Whether it is wrapped up in a pretty morally acceptable bow or not. It is tyranny.

The Iowa Supreme Court struck down an Iowa law proclaiming a marriage is to be between a man and a woman which ultimately led to gay marriages being conducted in Iowa. The public, which overwhelmingly disagrees with the SC ruling will have an opportunity to voice their objections to the SC Justices when a number of the court members come up for a retention vote in November. Word has it that there will be a campaign to oust all of the SC Justices who will be on the ballot, including the Chief Justice, who must receive 51% of the vote to remain on the bench. This should be a very interesting vote.

FYI, all Judges in Iowa are appointed by the Governor but are subject to a retention vote every four years. I know of only one Judge, a District Court Judge, who was voted off the bench in the past 30 years, but the gay marriage issue will bring out a lot of negative votes, imo.
