My argument is that the U.S. Constitution sets forth the limits of power which can be exericised by the federal government, and specifically provides that powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People. Nothing in the U.S. Constitution prohibits a State or a municipal government from establishing reasonable time, place and manner regulations on the use of public spaces controlled/owned by State or municipal governments.

So it is OK to petition the government so long as the time and place are agreeable to the government? Interesting reading of the 1st Amendment. And likely what will come out of a Scalia Court reading of the issue unless Kennedy grows a pair.

For starters, the OWS folks were not banning ANYBODY from using the park. Period.

Second, for the stuffed shirt douchebags like yourself who have a problem picnicking too close to a drum circle, it is not like there aren't parks ALL OVER MANHATTAN that you can use to picnic, party and protest at.

And last, Bloomberg's real issue was with the use of the park at night, when the population of Manhattan declines by 200% as the bridge and tunnel crowd flees for the safety of the outer edges of the Tri-State area. Is there some other group that wants to use Zuccotti Park at 2AM that only you are aware of?
